  1. IN exercise of the powers conferred by subsection 45(2) of the Animal Enactment 2015 [No. 8 of 2015], the Director of Veterinary Services makes the following order: Citation, application and commencement

(1)

This order may be cited as the African Swine Fever Disease Prevention

Control and Eradication (District of Kinabatangan) Director Order 2021.

This Order shall apply throughout District of Kinabatangan.

This Order comes into operation on 9 March 2021 and shall remain in force until revoked.

Section 2

In this Order, unless the context otherwise requires –

“Director” means the Director of Veterinary Services;

“disease” means African Swine Fever;

“owner” shall includes any person for the time being in charge of any swine and any person for the time being in occupation of any premise.

Section 3

Prohibition of movement

Subject to Order of subsection 45(1), no person shall, except with the written permission of the Director and under the supervision of the veterinary authority, carry out any action as stated under subparagraph 3(1) and (2) Order of subsection 45(1).

Section 4

Prohibition of slaughtering, selling or keeping

(1)

No person shall, except with the written permission of the Director and under the supervision of veterinary authority –

(a)

slaughter or cause to be slaughtered any swine which has been confirmed to be infected with the disease in District of Kinabatangan; or

(b)

sell or keep or cause to be kept any carcass of swine that has been confirmed to be infected with the disease in District of Kinabatangan.

(2)

The Director or any veterinary authority may prescribe any condition in the written permission issued under subparagraph (1) and such condition shall be complied by any person who slaughter, sell or keep the swine or its carcass.

Powers of the Director or veterinary authority

Section 5

The Director or any veterinary authority may at any time –

(a)

direct the owner of any swine to surrender the swine, swine product, its carcass or any article or substance as he deems necessary at such time, date and place for the purposes of examination and collection of samples for the purpose of testing, studying or monitoring of the disease and any costs and expenses thereof may be recoverable by him from the owner of the swine concerned;

(b)

direct the owner of swine, whether the swine is in herd or not, where its sample has been tested and confirmed to be infected with disease to take the following actions –

(i)

isolate such swine from the original herd and confine the swine in a separate place;

(ii)

immediately mark such swine based on the prescribed method; or

(iii)

dispose such swine based on the method specified by Director or any veterinary authority.

(c)

impose any other condition deemed necessary for the purpose of prevention control and eradication of the disease.

Keeping for breeding is prohibited

Section 6

No person shall keep or cause to be kept for the purpose of breeding any swine which has been confirmed to be infected with the disease.

Compliance of Order

Any person without reasonable reason refuse to comply or fails to carry out any prohibition, order, instruction, or requirement under this Order or under section 45

of the Animal Enactment 2015 commits an offence.
